Before applying you have to declare an estimation of the persons estate - this allows you to see if there is any inheritance taxt to pay. There is a helpful guide on the government website to help you through this.
If there is tax to pay, you must pay this first, then HMRC will send you a letter with a code. This code will be used when you’re applying for probate, so keep it safe.
So to move forward with probate you will need to apply for either letters of probate or letters of administration. This will confirm your legal rights to deal with someone's property, money and possessions.

It will usually take 16 weeks but there could be delays if you have to provide any more paperwork or information.
